Right of withdrawal
If you are a consumer, you have the right to withdraw from a distance contract within fourteen days without giving any reason, unless a statutory exception applies.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
Withdrawal period for physical goods
For contracts concerning the delivery of physical goods, the withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, received the goods.
If several goods from one order are delivered separately, the withdrawal period begins when the final item is received.
If goods are delivered in several parts or partial shipments, the withdrawal period begins when the final part or shipment is received.
Exercising your right of withdrawal
To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by an unambiguous statement, for example by letter or email:
Schimmer Records
Nico Rinker
Kappel 30
88436 Eberhardzell
Germany
Telephone: [ADD TELEPHONE NUMBER]
Email: [email protected]
Website: schimmer-records.com
You may use the model withdrawal form provided below, but this is not mandatory.
You may also use the electronic “Withdraw from contract” function available on our website.
To meet the withdrawal deadline, it is sufficient to send your notice of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from a contract, we will reimburse all payments received from you under that contract, including the cost of our least expensive standard delivery option.
Additional delivery costs resulting from your choice of a delivery method other than our least expensive standard delivery option will not be reimbursed.
We will make the reimbursement without undue delay and no later than fourteen days after receiving your notice of withdrawal.
Unless expressly agreed otherwise, we will use the same payment method that you used for the original transaction. You will not incur any fees as a result of the reimbursement.
For contracts concerning physical goods, we may withhold reimbursement until we have received the returned goods or until you have provided evidence that you sent them back, whichever occurs first. This does not apply if we have offered to collect the goods.
Returning physical goods
You must return or hand over the goods without undue delay and no later than fourteen days after informing us of your withdrawal.
Please return the goods to:
Schimmer Records
Nico Rinker
Kappel 30
88436 Eberhardzell
Germany
The deadline is met if you send the goods before the fourteen-day return period has expired.
You are responsible for the direct cost of returning the goods.
You are only liable for any reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
Digital WAV downloads
Digital music downloads sold by Schimmer Records are supplied as WAV files and are not supplied on a tangible medium.
For these digital contents, the statutory withdrawal period generally begins when the contract is concluded.
The right of withdrawal expires once we begin performing the contract and make the WAV file available, provided that:
- you expressly agreed that we may begin performing the contract before the end of the fourteen-day withdrawal period;
- you acknowledged that, by giving this consent, you lose your right of withdrawal once performance begins; and
- we provided you with the legally required contract confirmation on a durable medium, including confirmation of your consent and acknowledgement.
For immediate access to a WAV download, you will therefore be asked to actively select the following checkbox during checkout:
“I expressly consent to Schimmer Records beginning performance of the contract before the end of the fourteen-day withdrawal period and making the WAV file available to me immediately. I acknowledge that, once performance begins, I lose my statutory right of withdrawal.”
This checkbox is not preselected.
If the legal requirements for the early expiry of the right of withdrawal have not been met, the right of withdrawal does not expire merely because a download link was provided or used.
Personalised or custom-made goods
The statutory right of withdrawal does not apply to goods that are not prefabricated and are made on the basis of an individual choice or specification provided by the customer, or that are clearly personalised to the customer’s personal requirements.
This exception applies only where the legal requirements for genuine customer-specific production are met. It does not automatically apply merely because an item is second-hand, available only once or printed after an order is placed.
The normal right of withdrawal therefore continues to apply where a customer only selects from standard products, designs or other predefined options, unless the resulting product genuinely qualifies as a customer-specific or clearly personalised item.
Statutory rights relating to defective or incorrectly produced goods remain unaffected.
Sealed vinyl records
For vinyl records supplied in a sealed package, the right of withdrawal expires if the product seal is removed after delivery.
Opening the external shipping packaging does not constitute removal of the product seal.
This exception does not limit your statutory rights if a vinyl record is defective, damaged, incorrectly pressed, unplayable or otherwise does not conform to the contract.
Posters, postcards and regular merchandise
The normal fourteen-day right of withdrawal applies to regular, non-personalised posters, postcards, prints and other merchandise.
The exception for personalised goods may apply if a product is genuinely manufactured according to an individual customer specification. Selecting only from standard options does not automatically qualify as personalisation.
Defective or damaged products
The right of withdrawal is separate from your statutory rights concerning defective or non-conforming products.
These statutory rights remain available even if:
- the withdrawal period has expired;
- no right of withdrawal existed for a genuinely personalised product;
- the right of withdrawal for a WAV download has expired; or
- the seal of a vinyl record has been removed.
If an item is damaged, defective, incorrectly supplied or does not conform to the agreed specification, please contact us at [email protected].
